The Peloton treadmill machine has seen massive recall as a result of 72 injuries and the tragic death of a six-year-old child who was pulled underneath the treadmill. Users of the Peloton treadmill have sustained cuts, abrasion, broken bones, and minor injuries. Sadly, 29 of the 72 injured are reported to be children. The United States Consumer Product Safety Commission issued a warning on the Peloton Tread+ Treadmill stating “Adult users, children, pets and objects can be pulled underneath the rear of the treadmill, posing a risk of injury or death.” The warning and subsequent recall came after the death of the minor child and myriad of injuries. Peloton has offered refunds on all Peloton Tread + treadmills. While refunds are a good gesture for defective products, oftentimes the money cannot reverse the permanent and incapacitating injuries sustained from use of the product. As such, some Peloton Tread+ users are considering a product liability negligence claim.

The law states that a manufacturer can be held liable for injuries if their product is unreasonably dangerous. As to the Peloton Tread+, in order to succeed in a product liability claim, injured plaintiffs are required to prove the following four, key elements:
